Terms and Conditions 2025
TRAINING & MEMBERSHIP:
1/. Confirmation
By completing the application form you are agreeing to the terms and conditions set out below. To be entitled to full inclusion on the Gate Safe Aware Installer/Supporter database, the Gate Safe code of conduct must be completed.
2/. Payment Terms
All invoices are to be paid on receipt of invoice. Payment is required prior to the online training course; we do not offer credit accounts.
Any in-house bookings for training onsite are subject to a 50% deposit to secure the booking, this is non-refundable should the event be cancelled, full payment is required prior to Gate Safe providing any in-house training.
3/. Gate Safe training cancellation, rescheduling and transfer policy
Although rare, it may be necessary to reschedule a training course due to unforeseen circumstances, in this case we can either reimburse the full value of the invoice or transfer to the next available training date.
If you wish to cancel a course booking you must notify us in writing. Course cancellations are subject to administration fees in accordance with the following table of charges.
Should the delegate(s) cancel the Gate Safe Aware training the following charges will apply:
Period of notice Charge –
• Non-attendance of the course will forfeit the full cost of training.
• 8-14 days from date of course 50% of full invoice
• 7 days or less from date of course 100% of full invoice
• An admin fee of £50+vat for any refund to be processed
If you wish to transfer the booking to another course date there will be an administration charge per delegate.
4/. Code of Conduct
As a Gate Safe Aware Installer / Supporter, you will be expected to:
Encourage and demonstrate good practice within the gate automation industry
Educate your customers on the importance of automated gate safety
Adhere to the safety protocol for automated gates (and barriers) as defined in the Gate Safe guidelines
Provide the appropriate recommended products and services that will deliver a safe automated gate / barrier installation
Actively follow up all installations with the necessary maintenance regime as recommended by Gate Safe
Undertake risk assessments prior and post the commissioning of any installation and subsequent to any follow up visits
Instil in customers the importance of working with a qualified electrician with three years’ experience, to make the final electrical connection to the mains supply
Always leave a gate or barrier in a safe condition
Promote the importance of working with Gate Safe Aware installers to prevent any further accidents occurring
Always act professionally and do nothing to bring the Gate Safe name into disrepute
5/. Use of logo
All intellectual property including but not limited to registered and unregistered Trade Marks, is the property of Gate Safe GSSC Ltd (“GSSC”). GSSC retains ownership of its IP and this document merely allows the use of specific trade marks under specific conditions. The removal of any permission to use GSSC’s IP is at the discretion of GSSC, its directors, trustees and senior officers.
Any person or entity permitted to use IP belonging to GSSC agrees immediately to cease use when instructed to do so by GSSC, its directors, trustees and senior officers. This includes removing any of, or references to, GSSC’s Trade Marks from websites, invoices, letterheads, publications, pamphlets and any other sources of communication.
After undertaking the Gate Safe Aware Distance Learning a non-exclusive license is granted to the company, you will be issued with a unique, coded Gate Safe Aware Installer or supporter logo, see appendix for installer logo for use on promotional materials etc. You may not use the components of the logo to reproduce your own version of the logo. Gate Safe Aware Installer status will be subject to an annual renewal from the date of the first training date. The Gate Safe logo as displayed on the GSSC Website is not permitted for use by installers or supporters this is exclusively for the use of GSSC. Ensure you read the brand guidelines, see appendix, as misuse of the logo may result in termination of membership.
Failure to maintain membership with Gate Safe revokes any right to use the Gate Safe installer logo or any reference the Gate Safe membership / accreditation by the company. Failure to remove the logo from all marketing collateral within 30 days from cancellation of membership will result in the unauthorised use of the logo being passed to our legal team to enforce the removal of the Gate Safe logo.
GSSC own full copyright to “Gate Safe” and the logos, it remains the IP of GSSC.
6/. Training Pack
The A5 handbook and training pack will be dispatched to the delegate within 5 days of completing the course, if this is not received you must notify us within 28 days or a replacement manual will be chargeable at £55+VAT. Handbooks are dispatched to the address provided for the attention of the delegate(s) on the application form unless otherwise instructed.
7/. Gate Safe ID Card
GSSC provide a free of charge ID card for all delegates who successfully complete the IOSH approved training course. A photo for the delegate is required for the ID card, if a photo is not provided the ID card will not be issued. One ID card will be issued each year with current membership, additional re-prints will be charged at £35.00+ VAT and postage.
8/. Certification
The IOSH certificate for the delegate upon completion of the training is printed by IOSH and dispatched to GSSC or distribution. Certificates can take 4-6 weeks to arrive, if your certificate does not arrive within 6 weeks you must notify Gate Safe, failure to notify that the certificate has not arrived will mean that any replacements will be chargeable. IOSH certificate re-print is £35+VAT per certificate. Certificates will be dispatched for the attention of the booking contact provided on the application form unless otherwise requested.
Company Accreditation letters are sent out when training is completed to demonstrate the company’s membership with GSSC.
9/. Membership
Membership with GSSC is free of charge for the first year, membership starts on the date first trained and the training test successfully completed. Completion of the training and membership with GSSC give the right to use the Gate Safe Installer / Supporter logo. A company accreditation letter will be sent to the booking contact as proof of membership and training. The annual renewal will come into effect 12 months after the initial training course was completed. Training further delegates does not extend the free membership, the cost of membership is not part of the training cost.
The years free membership is only valid for the first time to company trained, should you not renew your membership there may be an administration charge of £165.00+VAT to re-instate your membership along with refresher training to ensure you have the most current version of the training.
9a/. Refund of Membership
Refunds or part refunds for GSSC membership are not permitted. Exceptional circumstance will be considered but are not guaranteed.
10/. Annual Renewal
The annual renewal for membership will be sent out in the first week of the month. An up-to-date company accreditation letter will be provided when payment is received. If the renewal is not accepted within 30 days, then we will need assurance that the logo will be removed from all print and digital marketing. Holding a Gate Safe IOSH certificate only demonstrates the training was completed, it does not assume membership with GSSC this is subject to the annual renewal. Payment against the annual renewal invoice will be acceptance of the terms and conditions.
11/. Training materials and documentation
Copyright in all training materials and documents provided by GSSC is retained by GSSC. You DO NOT have the right to reproduce the training materials including the delegate handbook, details from the Gate Safe website or any associated literature without express written permission of GSSC.
12/. Transfer of Membership
GSSC training can be transferred to a new company, the training must have been completed within the last two years to qualify for the membership to be carried over to a new company. Any delegates with training over the two-year requirement should undertake the training to allow the accreditation to be valid. This is subject to an administration charge of £165+VAT.
SITE SURVEY
1/. Survey
GSSC is only able to provide the site survey and risk assessment for compliance with The Supply of Machinery (Safety) Regulations 2008. The survey will cover the construction of the gate, suitability for use and the safety aspects of the system. Prices are valid for 30 days from date of quotation.
2/. Report
SITE SURVEY:
GSSC will attend site and complete a full risk assessment of the gate(s) / barrier(s) and provide a written report with a summary of the gate / barrier system, risks identified that require attention and supporting photographs to detail the specific risk. GSSC aims to return the report to you within 2 working days of the site survey being completed. Any surveys with more than 5 assessments may take longer to return the reports, we would aim to return these within 5 working days. Payment is required prior to GSSC attending site.
DESK SURVEY:
GSSC will provide an audit form to be completed by the customer and returned to GSSC with the supporting photographs / video as detailed on the audit form. An invoice will be sent and the report will be forwarded to the customer within 2 working days of payment being received.
3/. After report
Once you have received the report that GSSC is happy to discuss the content of the report with the customer / installer to clarify any aspects of the report that require clarification. We are not able to provide estimates for the works required to bring the gate / barrier up to standard, you should speak to a Gate Safe installer to receive quotations for the works.
4/. Contractual Matters
GSSC is not able to comment on any aspects of the contract between the gate owner and the installer of the gate. You may need to seek legal advice for pursuing any claim with the installer.
5/. Responsibility
The gate / barrier owner has a duty of care to ensure that all machinery is safe and compliant with UK Legislation. Responsibility for the works remain the responsibility of the installer / maintenance provider. GSSC takes no responsibility for the safety or compliance of the gate system.
6/. Health & Safety
As part of our own risk assessment, we must ensure that GSSC is not placing its staff in a dangerous situation when assessing gates and barriers, should we deem a gate unsafe to inspect then we would take detailed photographs and provide in writing why were not able inspect and provide a full assessment. Further attendance to site to assess the gate when able to do so would be chargeable.
7/. Unable to Assess due to Access to Site
GSSC surveys are always set at an agreed time and date with the customer, should we attend site and not be able to operate the gate, access the control cabinet, client not meeting us on site, are barred from fully completing our site survey for any reason, we will endeavour to take as many details as possible but this may compromise the details of the report. Any return to site to complete the works would be at an additional cost to be agreed.
8/. Enforcement
As a training charity we have no legal powers of enforcement, any unsafe gates should be reported to the relevant authority; HSE or Trading Standards.
ECS CARD – Gate Safe White Card
1/. Application
The applicant must have:
• IOSH approved Gate Safe aware training within the past two years
• Valid ECS Health, Safety & Environmental Assessment with at least six months before expiry https://www.ecscard.org.uk/content/Health,-Safety-Environmental-Assessment
To apply for the card, you must complete the required form in excel spreadsheet format for it to be uploaded to the ECS portal. The form should be returned to info@gate-safe.org to start the upload process, any forms with incomplete information will not be processed until the full required information is provided and may delay your application.
2/. Approval
Once approved, GSSC will forward the invoice for the ECS White card, when payment is received the card will be printed and dispatched.
3/. Photo Requirements
If a photo is required, please provide it in jpeg format any other format in line with the ECS requirements (https://www.ecscard.org.uk/content/ECS-Photo-Guide) will not be uploaded and will delay your application.
GENERAL
1/. Complaints
GSSC aims to provide a high level of service, if we fail to provide the level of service expected we aim to resolve all matters fairly and as quickly as possible. All complaints should be put in writing to GSSC.
2/. Aggressive, Abusive and Anti-Social Behaviour
As a safety charity, the welfare of our employees is paramount and we have a duty to protect them from any antisocial, abusive or aggressive behaviour.
All interactions with Gate Safe and GSSC through but not limited to; phone calls, emails, live chat, social media, should be professional. Should an individual or company behave in aggressive, abusive and anti-social to any of our staff then they will be subject to our abusive and aggressive behaviour policy.
3/. Refusal of Services
GSSC reserves the right to withdraw training, membership and accreditation at any time.
4/. Governing Law
The terms and conditions within this document are subject to the laws of England and Wales. The English courts have jurisdiction to decide any disputes which may arise which cannot be resolved by the preceding Complaints section.
APPENDIX
GATE SAFE BRAND GUIDELINES FOR INSTALLERS
Overview
The GSSC name and logo’s are part of our visual identity and validate the brand’s authority.
Only authorised users may use the relevant logo for reproduction on websites and print material. If you are authorised for use you must adhere to the guidelines to help us maintain the high standard and quality synonymous with the Gate Safe brand. You are only licensed to
reproduce the logo as an individual/company as per the unique licence number supplied by GSSC Ltd. The rules regarding the reproduction of this logo are non-negotiable.
The logo design
The GSSC brand and logo is NOT permitted for use by anyone other than the Gate Safe Safety Company Ltd. Incorrect usage of the logo may result in Aware Installer or Premier Aware Installer status being revoked.
